Essay / The initiative I chose to talk about is the Three Strikes Penalties for Repeat Offenders Act, Proposition 36. This proposition was introduced on the November 6, 2012 ballot as a state initiated statute. , where it was approved with a 69.30% rating in the state of California. This proposal was put in place to change elements of California's "three strikes" law, which was approved by the state's voters in 1994 through Proposition 184. There are 24 other states that have a form of three-strikes law in force to this day. . In 2004, Proposition 66 was a reform of the three strikes law, just as Proposition 36 was put in place and placed on the voters' ballot, where voters rejected Proposition 66. Proposition 36 would reduce the penalties for any offender of the third offense if the crime is neither serious nor violent. Depending on the type of your third strike, it would depend on the length of your sentence. A third offender for a serious or violent crime would still be sentenced to life in prison with the possibility of parole after 25 years. (quote kcet). If the third offense was a drug, sex or gun crime, they would also be sentenced to life in prison with the possibility of parole after 25 years. If the third offense is a minor or non-violent crime, people will receive double the normal sentence. Additionally, a person who has been convicted only once of rape, murder, pedophilia or other heinous crimes will receive harsher sentences, even if the third offense is minor. This proposal would also allow third “strikers” who are already facing life in prison to request a sentence reduction using the new proposal.
