On November 23, 2004, it was reported that Officer Juan Ornelas arrested Malaika Brooks for speeding. When Ornelas approached her, she refused to sign the traffic violation, so Ornelas asked Brooks to get out of the car. When Brooks still refused, Ornelas showed him his Taser. Brooks told Ornelas she was seven months pregnant and he explained different ways to tase her without harming the baby. Another officer, Jones, joined Ornelas. When Brooks got out of the car, she dropped her keys and Jones assigned her. Brooks sued the officers and the case went to court where it was realized that although the charge was unnecessary, it did not directly violate the Fourth Amendment. Other similar cases were reviewed with Brooks. The truth is that the law was not very clear on what could be considered excessive.
