Welfare Recipients for Drug Testing: Unconstitutional “A closed mouth does not feed” is a saying that many people have heard all throughout their lives. This saying was coined to encourage people to seek help in times of need. But what happens when open mouths beg to be fed and instead of receiving help, they are forced to be put down by going through a rigorous process that assumes all applicants enter the category of drug addicts? Guilty until proven innocent is the message sent to people seeking these services. Millions of dollars are spent each year on federally funded programs considered “welfare.” The types of services offered by these programs include TANF (Temporary Assistance to Needy Families), SNAP (Supplemental Nutrition Assistance Program) and more. In hopes of preventing those who use illegal narcotics from obtaining these services to finance their addiction, many states have implemented or considered implementing new procedures for applying for these benefits; conduct mandatory drug testing of individuals applying for government assistant positions. Because of the overwhelming number of people receiving welfare benefits, most lawmakers have drafted proposals mandating drug testing among applicants; this requirement is unconstitutional and should be repealed. One disorder that has sparked concern among lawmakers is substance abuse and dependence among welfare recipients. In an effort to identify illegal drug use among this population, legislators have proposed the use of chemical testing (Pollack, Danzinger, Rukmalie, & Seefeldt, 2002). In Missouri, this procedure is already in effect. In July 2011, Governor Jay Nixon signed the bill.
