  • Essay / Is America truly the home of the free? - 2245

What about freedom for all? The most common phrase in America today is “Home of the Free.” When America began in the colonies, the above quote was probably very true. Over the centuries, America has felt the need to regulate and curtail the freedom our founding fathers intentionally intended for us. Things like religion, reproductive rights, Native Americans and their rights, and the right to marry are marginalized. These rights could be considered private matters that the government should not get involved in, and probably rightly so. Children, especially in elementary and middle school, are constantly bombarded with propaganda. People like to impose things on others because, God forbid, someone disagrees with them. A particular problem is that of religion and the role it plays in schools. Some teachers and parents are completely opposed to any religious activity in their children's school and other teachers and parents want everything to do with religion at school. Much of the debate centers on the Establishment Clause of the 1st Amendment and the 1st Amendment itself. In 1971, at the Lemon v. Kurtzman Supreme Court hearing, it was decided that three questions had to be answered to decide whether something went against the Establishment Clause; does it exist or will it ever have a secular purpose, does it advance or inhibit religion, and does it require government involvement in religion. (Marshall 128) This seems simple enough. This ensures that the government protects Americans' religious freedom and keeps it out of the way as much as possible. Then, in 1973, in the Miller v. California, it was held that the First Amendment did not introduce any religious book into the laws of government. DOMA could be considered a religious act prohibiting homosexuals from the right to marry. Who can think of any reason other than religion why two men cannot marry? Then again, perhaps there is an answer to why they cannot marry and why DOMA was not subject to separation of church and state. As each child grows up, they have a different relationship with their parents. The mother, whether feminine or not, nourishes her child and cares deeply for him. The father, whether male or not, fights to protect his child from the evil people of the world. Without any of these roles, a child might become more hardened, with no one to nurture them and no one to protect them. People are entitled to their opinions and whatever their opinion is, it will determine whether the impact of DOMA and what has happened since is great or horrible..
