This essay is about Australia's land rights and how Eddie Marbo was not happy about his land being taken away from him. In May 1982, Eddie Marbo and four other Murray Islanders began bringing action in the High Court of Australia to confirm their land rights. Eddie Marbo was a Torres Islander who thought Australian laws were bad and fought and tried to change them. He was born in 1936 on Sea, known as Murray Island. The British Crown, in the form of the colony of Queensland, became sovereign of the islands upon their annexation in 1978. They claimed continued enjoyment of their land rights and these had not been validly extinguished by the sovereign. (Australian Bureau of Statistics 2012) The Marbo decision is an attempt to reclaim government land. Eddie Marbo was not happy with the way the government took native land away from indigenous people and he did not think it was fair for them to take the land away. He was not happy because he and his people had lived there for a long time and he did not want the government to own his land. The decision invalidated the doctrine that Australia was terra nullius. The High Court judgment found that indigenous property rights survived colonization, although they were subject to crown sovereignty. The only party who can lose in a native title claim is the native claimant. (Mabo v Queensland 2013) Marbo was not happy when they took his land illegally and he thought he had the right to go and fight to get his land back and he didn't think it was fair at all and he thought it was bad. It wasn't fair when all the white people went and took the children away from their parents and it wasn't fair... middle of paper ... moment in Australian history and government history. It's a good thing that happened too, because if they said no to Marbo and gave the land to the miners, the land would be dug up and destroyed and it wouldn't have been nice for the indigenous people's land to be dug up and that would not be the case. be fair to them either. The Mabo decision helped engender a new national narrative focused on inclusiveness, correcting past injustices and creating and improving the lives of all Australians, regardless of cultural and historical differences. My opinion on Eddie Marbo and what he did for the ingenuous people of Australia is that I recognize that he was very successful in achieving ingenuous rights through government and I also recognize that he is a legend for Australia and he stood up to the government and changed history for Australia and he should be remembered.
