In fraudulent misrepresentation, an individual not only lied or misrepresented a fact regarding a transaction, but did so intentionally, in order to mislead the other party in error. Individuals also enter into contracts that they would not normally do due to physical and economic duress and property duress. Undue influence in a contract occurs when one person has taken advantage of their relationship and uses it to their advantage over another person. Obstacles to Agreements in Contract Law Although fraudulent misrepresentation, duress, and undue influence are each different in their own way, they are types of assertion. which exist in contracts that an individual would not have concluded if these elements of affirmation had not existed. When agreements are made through fraudulent misrepresentation, duress and undue influence, the agreements are not considered voluntary and may be voided due to lack of mutual agreement.
