She believes criminal liability would prevent doctors from prescribing unnecessary medications to their patients. Doctors can currently incur civil liability in the event of the death of a patient by the victim's family, for a monetary value. Civil liability arises when another person sues for having suffered an actual loss, i.e. personal injury, property damage and/or financial loss, while criminal liability arises when a State sues the defendant and may face fines and jail time. Criminal liability can deter doctors from selling their services for profit and violating their Hippocratic Oath (whereby doctors swear under oath to uphold specific ethical standards). Physicians can also be convicted of fatal drug abuse of a patient under the Controlled Substances Act, as seen with Dr. Murray. The Controlled Substances Act requires any doctor wishing to prescribe controlled substances to register with the Drug Enforcement Association, which must then follow its specific guidelines. These guidelines include that prescriptions must be dated and include the name and address of the patient and the prescribing physician (Trachtman).
